I do not understand the judicial system

lately, here in Canada, you read more and more about sexual predators and offenders, and child abusers and murderers for that matter, getting out of jail ealier than their initial sentence.

I just dont understand what the point of sentencing someone to for example 10 years if they get out in 3 or 4, where is the justice in that. I just dont get it.

Here, in the vicinity a man was charged with sexual abuse causing bodily harm - he attacked a woman jogging in a neighborhood park and he was caught. Sentenced to 12 years for the crime, and lo and behold he is getting out in 1 month. And people on the news act like it is no big crime that he is getting released, meanwhile the woman who he attcked lives with this the rest of her life.

Where is the justice for the victims.

I just dont get it.

The criminal justice system is not designed to give justice to the victims, it gives justice to society.

Civil actions can give justice to victims, but it is generally limited to monetary rewards (no jail time).

While we feel long jail sentences are "satisfying" in terms of justice, the realities are that we are less likely to fund such a jail term and use parole to cut costs/grant some relief to the criminal.
 
so why do we even bother sending it to trial. If the object is to save money and to allow criminals the opportunity to convelesce, then why put everybody through the hassle of a trial.
Is it a matter of conscience. Does it make the justice system feel worthy - feel like they are doing it the right way.

meanwhile 2 months after release, they usually find themselves back in court spending more money only this time it may be a murder rap...

*if anyone is wondering I would call this sarcastic venting on my part*
 
i also find this to be an alarming trend, and it's not just in canada.

i can't help but see this as a sign that the judicial system doesn't view sexual violence as a gravely serious issue, even when it involves children. they hand down these slap on the wrist sentences and then wonder why it continues to happen so often.

there's also a tendency to focus primarily on the sexual aspect of the crime, while disregarding the fact that it ultimately is a violent display of power. men will be men, and it's up to us to keep ourselves safe and out of possible harm's way.

in terms of the cost-benefit analysis, i think we need to look at the cost to society of letting known predators roam free. not all costs can or should be measured in dollars and cents.

this is ties into another thread that MrsSpringsteen posted about the US government providing free viagra to convicted sex offenders. the fact that this was allowed to happen at all shows that the administration doesn't fully appreciate the devastating consequences of sexual violence.

I would suggest it is more a result of a healthcare system that wants to provide support to medical needs, but ends up with some absurd results.



Regarding sexual offenders, alternatives to incarcertation have not proven to be successful.

Last I checked, the victims ARE society. Members of, individually. All shocking crimes have an impact on society. Personally, more significantly, but we do not differentiate. Our legal systems certainly never should. Hence the farce.
 
Part of the problem is overcrowding of prisons....

The judgment relief given to an individual and that given to society are two different things.
