SIDNEY, Neb. - A judge said a 5-foot-1 man convicted of sexually assaulting a child was too small to survive in prison, and gave him 10 years of probation instead.

His crimes deserved a long sentence, District Judge Kristine Cecava said, but she worried that Richard W. Thompson, 50, would be especially imperiled by prison dangers.

"You are a sex offender, and you did it to a child," she said.

But, she said, "That doesn't make you a hunter. You do not fit in that category."

Thompson will be electronically monitored the first four months of his probation, and he was told to never be alone with someone under age 18 or date or live with a woman whose children were under 18. Cecava also ordered Thompson to get rid of his pornography.

He faces 30 days of jail each year of his probation unless he follows its conditions closely.

"I want control of you until I know you have integrated change into your life," the judge told Thompson. "I truly hope that my bet on you being OK out in society is not misplaced."

District Judge Kristine Cecava of Cheyenne County on Tuesday sentenced Richard Thompson, 50, on two counts of sexually assaulting a minor. He given 10 years of probation by a judge who said the man was too small to survive prison.

On Thursday, Nebraska Attorney General Jon Bruning said he'll appeal the decision.

"I don't care if he's 3 feet tall," Bruning said. "If you abuse a child, you're going to pay a price."

WTF? Can't they put him in solitary or something? Why isn't it incumbent on the prison system to make sure he can be properly incarcerated?

So basically he get's away with molesting an innocent child. Personally I say height doesn't matter at all and he should serve a prison sentence like other child molesters.

I read that yesterday, what the hell is wrong with some of these judges? Talk about coddling criminals.

Children are all too small to be sexually assaulted.

fucking stupid,
oops sorry that seems to be a pre-requisite for judges around the world, call me old fashioned but I personally don't see any justification for keeping paedophiles,rapists,&, murderers on this planet, or maybe we could use them to replace animals being tested on, & once they've served their purpose that way let the filthy scum rot on a deserted island, I'm sick to the back teeth of reading about the disgusting crimes carried out around the world & the lenient sentences handed out by "judges,"when are people going to show more concern for the victims & their families than trying to "understand" the criminals, so we can rehabilitate them & re-intergrate them back into society, we don't want these disgusting pieces of filth in society, try to imagine just what thoughts must be racing through a young childs mind as some monster is about to rape/& or murder them if you can, what sort of horrific thoughts must be going on in an innocent childs head at such a sickening event, & then try to justify keeping whatever sick, twisted creature that could force such an innocent, defenceless person through such an ordeal, alive. Execution would be too merciful for the bastards!
