Its already been proven that Saddam had illegal WMD. Its incumbent upon Saddam to prove that he no longer possessed such weapons. He had an opportunity to do so. He decided not to.

Saddam was already proven guilty, the burden of proof was on him to show that he was clean and sober. He failed the test because he did not take it.
