also, have you ever heard something called 'the tyranny of the majority'? if majority has the right to do whatever they want, including screwing over the minority, that is no democracy in my opinion
the Bill of Rights was created to address this issue. Unfortunately, many Supreme Courts did not interpret the Constitution strictly and came up with such doozies as the 3/5 compromise. The "living, breathing document" must have accidentally hiccuped.
