if they were really out to get him then they would have found him guilty for raping the intoxicated/nearly passed out 17 year old. but he was aquitted of that. unfortunately, the oral sex with the 15 year old was on the same tape and the law says it was a mandatory 10 years.

btw they have already changed the law, but it was too late to help him

Well, I don't agree with the statutes in this particular case, but lessening one statute because someone made a crazy judgment with another isn't a great approach...
 
This is awful - most of my 15 year old friends have boyfriends around 17/18. And I'm pretty sure most of my friends have participated in more than oral sex with their 17 year old boyfriends, yet I don't see it as perverse.

With all the anti American stuff people are saying - I'm European, and this sort of crap happens in Europe too. Especially England - we have thousands of really backward laws that everyone knows are backward but no one does anything about. It isn't just the US.

Thanks. This is just ONE incident that of course gets a lot of attention b/c of how ridiculous it is. It's not like we're sending teens off to prison on a daily basis for fooling around. It's the type of thing that you never realized existed until it comes up like this.

It's a criminal offence to leave a fishing hole (in the ice) unguarded in Canada. How fitting, no?

It's also a criminal offence to "frighten the Queen."
 
This is an age of consent case, and the girl was below that age. So the "consensual" in the article is legally incorrect. Perhaps they charged him as an adult on this.
 
Perhaps the teen could work off his time as a soldier in Iraq. It'd be cheaper and we'd have one less "sodomite" on the continent.

Points well noted, Harry Vest, but the judges and jury couldn't do anything about it because they don't create the laws, nor can they change them in the courtroom to suit their needs.

I'm not a lawyer but I believe he could appeal all the way to the Supreme Court claiming the law is unconstitutional. Though the composition of the court has changed, they did throw out the Texas sodomy law a couple years ago.

And yeah, every country that is old (not old, like you had Romans settle your cities, but since the founding of your current Republic...so Germany for example is only just over 60) has this problem, the older the body of law the worse it gets. Voters and press reward legislators for passing laws, not repealing them, with the rare high profile exception. You'd think they could come up with a systematic fix - automatically review laws when they are x many years old or something.
 
Despite being just 60 years old, we have stupid laws as well ;)

Hoepfully he can appeal before a higher court, but it sounds like he is one of those cases where you can't do much because the time he was sentenced the old law still was in power :sad:
 
In Singapore, there was a case a few years ago about this very same issue.

Apparently thanks to the legacy of British colonial law oral sex was still technically illegal in Singapore, and this bloke got charged for it.

The charges were dropped (or were clarified, I think) but he still got jail time though, for sex with a minor. Still, considering he was near 30 at the time I suppose he got what was coming to him.

Anyway there was a law review this year and a lot of the old colonial legacy kind of laws were scrapped so now it's OK to have oral sex (jeez, felt weird typing that). Unless you do it in public, of course.

Except he could get pardoned by the governor or even the President.

But considering that both probably still live in the Stone Age and don't want to offend "Concerned Christofascists for America" or something of the sort, he'll probably stay in prison.
 
Not sure if all the sodomy stuff is relevant, unless I'm missing something...I assume he'd get the same punishment if it was regular old sex. The issue is age of consent, right? If so I'm pretty sure all states have laws against sex with underage girls. If he's getting a stiffer penalty because it was oral sex then that seems unfair. Also, if the issue was oral sex, rather than age, shouldn't the girl be punished too?
 
5 questions:

1. Did they have intercourse?
2. Are here parents heavily involved with the prosecution?
3. Didn't R. Kelly do a very similar act - and is still alowed on MTV and tour the US arenas?
4. Was the video the only reason he got charged?
5. Where is the creating underage pornography charge?

I would have no problem if he got 10 years for #5.

That is unbelievable, I really can't find the words to do justice to how bad that makes me feel, he's only a kid himself, what kind of fucking drugs do judges take before they pass sentence!
 
These "Judges" will suffer the same treatment (or worse) in the future - weather it is here or in another world altogether. Shame on these so called "keepers of the law"!!! True justice will prevail one day.

Hey I'm in total agreement that the punishment is not befitting of the "crime" and the law needs to be changed (apparently has?), but you would honestly support a legal system where sentencing is completely open-ended for the judge to decide? Quite a dangerous precedent you're arguing for here, don't you think? And how is this ALL the judge's fault that s/he should be damned to hell? Didn't s/he admit that the mandatory sentence is outrageous?
 
Mandatory sentences like the ones that people demand whenever a paedophile gets off with a lenient sentence. Regardless a young mans life has been ruined.
