I see what you're saying, but there should be a distinction between original soundtracks and more compilation-based soundtracks.

Like Prince's Batman soundtrack vs. a Shrek soundtrack for example.

That's what I mean. A score is okay if you use it in a creative way but if you use a song from a compilation soundtrack then you have to make sure it serves a unique purpose. You could imagine a sort of advantage in stealing the work of soundtrack. It was like the playlist where you had three or more Life Aquatic songs and the cover came from the movie. You are playing off the work of others too much. You know what I mean?
