PANAMA CITY BEACH, Fla. - A couple is suing the franchisee of a McDonald's restaurant, claiming an improperly prepared bagel damaged the husband's teeth and their marriage.



John and Cecelia O'Hare sued Friday for unspecified damages more than $15,000. They alleged the McDonald's, owned by Johnstone Foods Inc., was negligent and violated an "implied warranty that the food sold was reasonably fit for human consumption."


They contend in the suit that John O'Hare broke teeth and bridgework on Feb. 1, 2002 when he bit into the bagel. The suit did not say what exactly was wrong with the bagel.


The suit alleges the wife "lost the care, comfort, consortium and society of her husband." The couple's attorney, Tim Warner, did not return telephone messages left at his office.


Tracey Johnstone, owner of Johnstone Foods, said she never before had a bagel complaint and had no idea how it could have been prepared in a way that would damage teeth.


"It's a bagel," she said.


Jeez...I hope that when I get married he doesn't break a tooth, because then I would have to divorce him

some people will do anything to squeeze money out of mcdonalds these days. i hope the case gets thrown out.

What dumb people. I don't think there's an "implied warranty" that food must be prepared for people with damaged teeth--the "bridge work."

And divorcing your husband over a bagel?

How do damaged teeth cause someone to lose "care, comfort, consortium, and society" of someone else? These people are crazy.

well, when i eat a milk maid caramel and my filling comes out, i'll be sure to sue them because of that implied warranty! or when i eat nuts (and "forget" i'm allergic) and spend the night throwing up and end up in the hospital, i'll sue planter's!

that quote sounds like she's some pathetic housewife who can't survive without her husband. care? comfort? can't this woman take care of herself because his dental work got messed up? wow, my mom should've sued sbarro's because once my dad's implanted tooth broke in half when he bit into the pizza. guess what? they've been married for 25 years now without a single hint of even a separation.

Do you or did you ever have acne? you can sue them because the fatty foods gave you zits.

Did you ever get a happy meal toy you didn't want? You can sue for emotional distress.

Have you ever had to wait longer than a minute for your food? You can sue for breech of contract, "implied contract" that it's fast food.

Have you ever actually seen Ronald McDonald in person at your local McDonald's? If not, you can sue for false advertising, he's always there in the ads, he should be at your local McDonalds.

ooh, good idea! i think i'll sue because i've never seen cedric, or as i call him, "the" at my local mcdonald's. or maybe i should sue because several times when i go, my orange soda is watery.
